Sales Agreement
Conditions of sale:
Breeder guarantees that the previously described dog is a purebred dachshund parents.
Breeder guarantees that this dog is in good health at the time of purchase and that immunizations are up to date.
Breeder guarantees a minimum life of 5 (five) years unless the death is caused by a preventable cause or if the purchaser did not follow the diet and/or care instructions of the breeder. No spay/neuter before 14 months of age. No harness. No zip leashes. Preventable causes include but not limited to, Accident (e.g.. motor vehicle accidents, dropping or stepping on the dog), Poisoning (deliberate or accidental), Attack by an animal or person, lack of recommended or preventative care, Improper feeding (obesity puts added stress on the back, heart, and other organs/muscles of the dog). If the dog dies before 5 (five) years of age from a non-preventable cause, the breeder will credit the buyer with a prorated discount on the purchase of a subsequent dog.
Signed proof from a licensed veterinarian, stating cause of death required by breeder, to facilitate prorated discount. If the dog passes within the first three years the dog will be replace with a new dog from the breeder with a sign letter from a licensed veterinarian.
Breeder is not responsible for any accident, death or loss during shipment.
Purchaser assumes full responsibility of said animal when it leaves the breeders possession.
Breeder agrees to take said dog back at any time if the purchaser is no longer willing/able to care for it and try and find a suitable home. When a home is found the purchaser will be refunded a prorated amount determined by the breeder. Purchaser agrees not to give/sell this animal to any party without first giving the breeder first right of refusal. Purchaser agrees that in case of discrepancies the breeder’s decision shall be final and binding. Any returned animal that is in the possession of the breeder for more than 6 months or if expenses exceed previously determined value of the animal automatically becomes property of the breeder again with no exceptions.
Purchaser agrees to maintain said dog at all times in good health with at least annual veterinary check ups and recommended vaccinations and to provide quality nutrition, shelter, and medical care. Buyer also agrees to ensure the physical and emotional well being of the dog at all times.
Purchaser agrees to never to tie the dog to any fixed object while unsupervised.
Purchaser agrees that said dog should never be used for experimental or research purpose.
Purchaser agrees to notify the breeder as soon as possible if the dog requires medical care other than routine vaccinations, and check ups, any all problems must be reviewed by breeders veterinarian and deemed necessary before any replacements can be given.
Purchaser assumes full responsibility for the health, temperament, and appearance of said animal when the animal leaves the breeders possession.
Purchaser agrees that at no time, for any reason will the breeder be responsible for any veterinary bills.
Purchaser agrees that they are responsible for the actions and upbringing of said dog and at no time will the breeder be held responsible for the dog or its behaviour.
Purchaser agrees to NEVER under any circumstances give this dog to a rescue group, animal shelter, or humane society.
Purchaser agrees that if this dog is sold as a pet and not for breeding purposes that the dog shall not be bred unless given written permission HavenlyHund Reg’d. A $10,000.00 fine shall be levied and this fine shall be binding upon the said purchaser.
Purchaser and Breeder agree that this agreement and the purchase and sale of said dog shall fall under the jurisdiction of the laws in the city of Langley, in the province of British Columbia, in the country of Canada and that any matters with respect to this agreement shall be dealt with as per the laws governing this location. It is further understood that any circumstances/situations/disputes arising which are not covered in this agreement shall be remedied at the discretion of the breeder and that the breeders decision shall be final and binding.
I, we the breeder (or representative) and buyer(s) certify that we have read this contract in its entirety, understand its contents and fully agree to it.
